TERMS AND CONDITIONS

Dirty Ducats and affiliated sites are owned and operated by Sierra Blue Internet. These terms and conditions constitute the entire agreement ("the Agreement") between Sierra Blue Internet and its Advertisers and supersede any other written or oral representations, statements, understandings or agreements. By advertising sites owned by Sierra Blue Internet, you agree to be bound by this Agreement.

Important: Sierra Blue Internet reserves the right to terminate any account, at any time, if its directors believe these terms and conditions have been breached in any way. In such an event, all accrued funds may be forfeited.

Spamming is prohibited. You may not use unsolicited e-mail, newsgroup postings, message board postings, irc, icq, chatrooms or any other spamming methods to promote our sites or our program.

Association with illegal activities is prohibited. You may not promote our sites or our program on sites that endorse, promote or feature child pornography, bestiality, rape, violence, torture or any other illegal activity. This applies even if the activity is legal in your jurisdiction.

You must be over 18 or 21 if that is the age of majority in your country of residence – to participate in the Dirty Ducats program

Independent Investigation: You acknowledge that you have read this agreement and agree to all its terms and conditions. You understand that we may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this agreement or operate web sites that are similar to or compete with your web site. You have independently evaluated the desirability of participating in the program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.

Linking. You must link to the site in accordance with our current specified linking procedures. You may not use pop-ups or pop-unders within a link that leads to any of our sites.Webmasters are responsible for using linking in accordance with published links. Use of links which do not conform to the published procedures is a violation of this agreement.

The trademark names and phrases of Dirty Ducats web sites may not be used in any type of search engine listings, any kind of directory listings, in web page meta tags, or in any url. Use of trademark names and phrases is considered trademark infringement and will result in cancellation of the affiliate account and all future AND PAST revenue sharing payments. Dirty Ducats and its parent company reserve the right to seek legal remedies against any person, company or entity that infringes on our trademarks.

Newsletters. You must keep a current email address on file with us in order to receive newsletters. Please whitelist tony@dirtytony.com and affiliates@dirtyducats.com. All newsletters attempt to give you the most current information and linking codes. It is your responsiblity to verify that the codes and other information is correct before you publish them.

Payments are made directly by our processor: CCbill.

Cascading. We reserve the right to use multiple processors, including CCbill and Epoch. Regardless of which processor is used, all properly linked affiliate traffic will be credited through the CCbill cascade and paid from CCbill.

Use of graphics and intellectual property. Any materials on any sites owned by Sierra Blue Internet is copyrighted. You may not use any of these materials without prior consent. All materials must be used in a manner deemed acceptable by Sierra Blue in it's sole discretion. Use of materials to promote other products or which do not link directly to our sites is cause for termination and possilbe legal action. You are NOT permitted to re-watermark any promotional material.

Modification: We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site. Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

Technology. Sierra Blue Internet may not be held liable for technical failures resulting in downtime or delays that affect the performance of the Dirty Ducats program or our sites.Affiliates hereby acknowledge and accept that the tracking system employed by Dirty Ducats is not 100% fail-safe and that there may on occasion be instances of referral sales made that are not credited to an affiliate for any of the following possible reasons:
Failure by the affiliate to use the proper format of the specially assigned URL in promotions, web page links, banner ads, and so on.
Deliberate or accidental actions by customers to circumvent an affiliate's special URL so that our software is unable to accurately track that sale.
Bugs, glitches or crashes of the tracking software that render it unable to accurately track sales for a period of time.
Acts of nature that cause irretrievable data loss on the computers and back-up disk media.

Relationship of Parties: Sierra Blue Internet and your company are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this agreement.
